Indiana Lawsuit Filed


Fellow THR Advocates,

Per the following, the Right To Be Smoke-Free Coalition has been formed, and litigation has been filed (see attachments) challenging Indiana's recently enacted law that bans the sale of e-liquid unless/until the manufacturer (including out-of-state manufacturers) spend massive amounts of money to comply with totally unwarranted regulations (that exempts cigalike e-cigs). The coalition seeks support for its activities to ensure that e-liquid manufacturers can continue selling their products in Indiana, and to discourage other state legislatures from enacting similar laws.

I hope you have been well.  I thought you might be interested in a quick update on the Indiana lawsuit.  On behalf of the newly formed Right To Be Smoke-Free Coalition, on

September 18 we filed a complaint and motion to intervene in the lawsuit challenging the constitutionality of the new e-liquid law in Indiana, which will make it virtually impossible to sell e-liquids used in open-systems in that state starting July 1, 2016. 

I've attached our complaint and brief supporting the motion to intervene.  Your thoughts would be much appreciated.  We are actively recruiting responsible e-liquid and open-system device companies to join the Coalition or contribute to the cause, as the legal
and expert witness fees are quickly adding up, as I am sure you can imagine.  We currently have three members: Vapor Shark, Cosmic Fog Vapors and Mt. Baker Vapor, but we will need to have a broader coalition of big and small companies to succeed here.  We
expect Indiana to vigorously defend its law.  If you know of any such companies in the industry that may be interested in participating, please feel free to forward along these documents (I've also attached our marketing brochure) and my contact information.
